Injured truck driver - Nearly seven figure settlement after two previous attorneys advised that there was no chance of recovery and dropped the case.

Jason Cohn received a call at 6:00pm at the office from a colleague regarding a terrible truck accident his friend had been involved in.  Both Saar Swartzon and Jason Cohn spoke with the client briefly on the telephone (with the use of a Spanish translator) and determined, as we often do, that an in person home consultation was necessary due to the person’s very severe injuries.  Jason and Saar dropped what they were doing and immediately drove to the injured man’s home, even though it was after hours.  After spending a little time getting to know this gentle man and his family, we quickly realized a pile of medical bills at the table where we were all sitting.  It became clear from looking at this man that he had indeed suffered severe injuries as a result of someone else’s negligence.  The horrific story unfolded–his co-truck driver fell asleep at the wheel and careened off the road into a freeway overpass, completely destroying the truck and its payload.  The force of the impact was so great that it caused the engine to rip from its mounts and become airborne.  The client’s legs, pelvis, spine, and head were severely injured. He was airlifted to several hospitals where he was treated by doctors for the polytrauma he endured from the accident.

The client went to a worker’s compensation attorney.  After spending months working on his case, the attorney abruptly dropped his case after discovering the client’s employer had no worker’s compensation insurance.  The client then consulted another attorney who failed to work on the case for six months and then dropped it because he didn’t feel that he could recover any money for the client.

Jason and Saar took the case and began digging to find some way to get the compensation the client deserved.  Through hard work, diligence and persistence, Jason and Saar were able to find a commercial insurance policy for the employer.  Though they fought hard not to cover the accident and the clients injuries but they eventually relented and COHN & SWARTZON, P.C. were able to get the insurance company to pay the entire policy out, nearly seven figures, pay off his medical bills and get the client a substantial recovery.  Jose and his family can attempt to regain some normalcy in their lives and enjoy their time together.
